For specific orders, you will of course receive the relevant contract documents before the contract is concluded. This applies in particular to key terms such as Delivery Terms, Default (Delay) and Force Majeure, as well as the respective roles of the Carrier and the Client (Customer).
Under clause 23, the ADSp limits the statutory liability for goods damage under § 431 HGB (German Commercial Code) for damage during multimodal transport including a sea leg, as well as in the case of an unknown place of damage, to 2 SDR/kg, and for other multimodal transport to 8.33 SDR/kg. For the breach of advisory duties, liability is limited to a pecuniary loss of € 8,500.00 per case of damage.
